La Diferencia Entre El Dolo Civil Como Vicio De La Voluntad Y El Delito De Estafa En El Derecho Cubano

Abstract

Desde la antigua Roma, se confunde la defraudación caracterizada por la astucia con la maquinación o artificio de que se sirve uno de los contratantes para engañar a otro. La doctrina y la jurisprudencia no coinciden en sus criterios, existiendo diversidad de posiciones. Es propósito de esta investigación, determinar los fundamentos teóricos que permitan establecer la diferencia entre el Dolo Civil como vicio de la voluntad en la concertación de negocios jurídicos y el delito de Estafa. Se caracteriza brevemente el Dolo Civil y el delito de Estafa, analizando además las distintas concepciones existentes que pretenden solucionar la problemática en torno a los elementos distintivos entre ambos.
