El Derecho Del Mar, Y La Aplicabilidad Del Principio De Territorialidad

Abstract

La territorialidad es un principio básico del Derecho Penal y admitido como tal en casi todas las legislaciones. En virtud de este principio corresponde aplicar la Ley penal de un Estado en el espacio, a todos los delitos cometidos dentro del territorio del mismo, con independencia de la nacionalidad de los sujetos activo y pasivo del delito. El fundamento principal de este principio se encuentra en la idea de la soberanía estatal, el Derecho Penal emana de ella, es por lo que ha de aplicarse dentro del ámbito territorial determinado por este.
