O Principio Constitucional Da Função Social Do Contrato E Sua Aplicabilidade Na Órbita Do Direito Civil

Abstract

A expressão função social no âmbito do Direito privado tem sua origem normativa vinculada à função social reconhecida à propriedade, por circunstância da sua previsão nas Constituições mexicana, de 1917, e alemã (Weimar), de 1919. Em tese, o reconhecimento da função social da propriedade teve por objetivo principal a atribuição de deveres jurídicos ao titular do Direito subjetivo, em paralelo aos poderes jurídicos que decorrem desta titularidade (usar, fruir, dispor...). A função do conceito era o de limitar a ampla liberdade de exercício do Direito pelo proprietário, em razão de interesses valorados como preferenciais, o que no caso se identificam como os interesses sociais.
