La Argumentación Jurídica En La Sentencia

Abstract

Desde años atrás, una de las labores más complicadas que enfrentan los jueces en la administración de justicia, es precisamente la redacción de las sentencias que culminaban un proceso de cualquier índole, dado ello por la complejidad de la correcta aplicación del Derecho a los casos concretos que se ventilaban en la práctica. En el decursar del tiempo esto no ha cambiado, sino que por el contrario, aparejado a los nuevos cambios históricos, económicos, políticos y sociales, se hace más difícil esta tarea, pues precisamente uno de los retos que se impone la actualidad, es la de confeccionar una sentencia judicial capaz de responder a cada una de las exigencias planteadas por las partes litigantes, a la sociedad que nos evalúa y en nombre de quien administramos justicia y a la propia conciencia de los jueces.
