Abstract

La pena privativa de libertad a través de la reclusión en el establecimiento carcelario, presentada como una opción alternativa y humanizante para el sistema punitivo vigente hasta el siglo XVII, que tenía como base las penas de muerte y corporales, desde su nacimiento se ha demostrado ineficiente para cumplir sus finalidades formalizadas por el ordenamiento, principalmente los que se refieren a la reinserción del penado a la sociedad.
