Abstract

El mercado de los bienes culturales se encuentra sujeto a normativas nacionales e internacionales proteccionistas, a pesar de lo cual los recursos son cada vez más escasos. Se presupone que los bienes culturales son patrimonio común, dotados de un valor estético y simbólico al que todos deberíamos poder aspirar, pero el consumo cultural los han dotado también de un valor económico. Su materialidad los hace vulnerables a la degradación y al mercado negro. Tal situación impone una jurisprudencia más efectiva, aunque en ocasiones se revele contradictoria. En medio de toda esta polémica, se hallan los llamados museos universales.
