Abstract

The adoption of Regulation (EC) 139/2004 has entailed an important reform of the EU merger control system to improve these kind of transactions have on competition. The entering into force of the new Regulation has been coupled with further implementation rules, which in practice results a global modification of the regulatory framework applicable to the concentrations among enterprises. This article aims to analyse the most significant developments in this field making special reference to the amendments introduced in matters connected with the material, jurisdictional and procedural aspects of the new EU merger control system.
