Una aproximación jurídico-penal a la circulación de obras del espíritu a través de redes peer to peer: algunas notas sobre la responsabilidad criminal de los usuarios

Abstract

Right now, one of the main achievements of peer-to-peer (P2P) technology has been the articulation of networks so as to be able to freely share information (materialised in computer files) between equal subjects. Among the information shared through these neutral and decentralised networks (that operate in the Internet apart from the World Wide Web) there are works of the spirit that deserve the legal protection exercised by the laws on intellectual property, the owners of which have not authorised their reproduction and distribution by this means. The present study questions the penal relevancy that, according to Spanish legislation, it is possible to attribute to the conduct (fundamentally, up-loading and down-loading) developed by those who surf in these networks.
