El modelo financiero del concierto económico

Abstract

The purpose of this article is to analyze the structural features of what it has been called the Concierto System (as opposed to the LOFCA System). Though this topic lends itself to a political apology or to an ad probandum historical treatment, the present work adopts an approach characterized by a more analytical and conceptual treatment rather than a normative and descriptive one. After a first didactic approach to the Basque financial capacity according to the Concierto Económico, the author, using analytical means, proposes a more precise definition considering both the initial methodology of the Concierto law and the methodology established by the 44/1988 Cupo law. In opposition to some opinions seeded after the publication of the latter law, the article concludes that both methodologies rest on an identical conceptual structure, being the only difference the way of assessment of the assumed charge. Finally, it is obvious the absence of an empirical analysis using a global approach, investigating the evolution of different structural variables of the financial capacity designed by the Concierto Económico.
