Las empresas como posibles responsables penales y los planes “compliance” como herramientas de solución

Abstract

[ES] Nuestro ordenamiento jurídico ha establecido que las empresas pueden ser condenadas en un proceso penal como responsables penales por haber cometido un delito, generando una gran incertidumbre y una gran responsabilidad en el panorama empresarial. Además, esta novedosa responsabilidad penal ha sido establecida sobre pilares tremendamente complejos y viene acompañado por los denominados como planes “compliance” o planes de prevención penal como instrumentos organizativos para atenuar o eximir a las empresas de esta especial responsabilidad. En todo caso, esta nueva responsabilidad penal ha llegado a nuestro ordenamiento jurídico para quedarse y supone un factor esencial en la gestión de los riesgos de la actividad empresarial, y por tanto, debe ser cuidadosamente atendida.
