Raskid ugovora

Abstract

Iako je ispunjenje najèešæi naèin prestanka ugovorne obveze i ostvarenje svrhe sklapanja ugovora, dosljedno poštivanje naèela pacta sunt servanda u odreðenim sluèajevima može rezultirati nepraviènim rješenjima. Stoga sva suvremena zakonodavstva pod odreðenim okolnostima dopuštaju raskid ugovora: sporazumno, jednostrano ili na temelju zakona. U èlanku se govori o naèinu, pretpostavkama i uèincima raskida ugovora, ali i o razgranièenju od srodnih instituta i terminoloških pojmova koji izazivaju nedoumice u praksi. Osim odredaba ZOO o raskidu ugovora, navode se i odredbe posebnih zakona o raskidu pojedinih vrsta ugovora koje na neki naèin odstupaju od rješenja sadržanim u ZOO-u.
