Inspekcijski nadzor – doseg najavljenih izmjena

Abstract

U radu se analiziraju specifènosti inspekcijskog nadzora kao vrsta poslova državne uprave. Obraðene su znaèajke inspekcijskog nadzora i postupanje inspektora. Naroèito se istièu procesnopravni aspekti uz analiziranje sadržaja mjera koje nakon provedenog nadzora poduzimaju inspektori, osobito kad se postupak inspektora odvija u pravcu donošenja upravnih i kaznenih mjera. Opisuje se zaštita prava stranaka u inspekcijskom postupku, s posebnim osvrtom na primjenu naèela razmjernosti, ureðenju odluèivanja u drugom stupnju i odreðenost propisivanja upravne mjere. Iznose se prijedlozi i inicijative oko moguæeg inoviranja regulatornog okvira donošenjem jedinstvenog zakona o inspekcijskom nadzoru, a sa svrhom izbjegavanja ureðenja procesnih pitanja posebnim zakonima i bez nepotrebnog ponavljanja, koje bi mogle vrijediti u svim upravnim podruèjima.
