Die Ökonomisierung der Europäischen Fusionskontrolle: eine Evaluierung

Abstract

The role of merger control is to protect the interests of consumers over those of major corporations. To improve this protection, European merger control underwent comprehensive reforms in 2004. The aim was to increase the importance of economic principles in reaching verdicts. An empirical study indicates that the Commission is now making fewer mistakes since the reforms. However, prohibiting mergers, which sends a clear signal to the market, happens all too rarely. Aufgabe der Fusionskontrolle ist es, die Interessen der Konsumenten großen Unternehmen gegenüber zu schützen. Um dies besser zu ermöglichen, wurde die Europäische Fusionskontrolle 2004 einer umfassenden Reform unterzogen. Das Ziel war, den Stellenwert ökonomischer Prinzipien bei der Urteilsfindung zu erhöhen. Eine empirische Untersuchung zeigt nun, dass die Kommission nach der Reform weniger Fehlentscheidungen trifft. Allerdings werden Verbote, die ein klares Signal an den Markt sind, zu selten eingesetzt.
