Menschenhandel: Deutschland beim Opferschutz nur Mittelmaß

Abstract

The recently released 3P Anti-trafficking Policy Index shows that policy performance against human trafficking demonstrates mixed results worldwide during the period of 2000-2011. Most countries have adopted anti-trafficking law in their legal systems and committed to criminal justice (prosecution policy). Preventive efforts against the crime (prevention policy) are also high. However, many countries fail to ensure the human rights protection of victims (protection policy). In the recent years, Germany also neglects recognizing victims and granting them amnesty. In 2011, the protection policy of Germany is evaluated as 'modest (score 3)' only, while the levels of its prosecution and prevention policies are ranked as 'adequate (score 4)' and 'strong (score 5)', respectively. Mehr als 2,45 Millionen Menschen sind laut den Vereinten Nationen Opfer von Menschenhandel, die Dunkelziffer ist hoch. Viele Staaten haben deshalb ihre Bemühungen verstärkt, gegen Menschenhandel vorzugehen und den Opfern zu helfen. Das DIW Berlin hat nun den 3P-Index, der die staatlichen Aktivitäten in den drei Feldern strafrechtliche Verfolgung, Opferschutz und Vorbeugung (prosecution, protection and prevention) international vergleichbar macht, aktualisiert. Damit deckt der Index den Zeitraum von 2000 bis 2011 lückenlos ab. Im internationalen Durchschnitt sind die Bemühungen bei der strafrechtlichen Verfolgung am stärksten, und die größten Zuwächse sind im Bereich der Prävention zu beobachten. Die Unterstützung der Opfer ist hingegen in vielen Ländern eine Schwachstelle. Deutschland erfüllt im internationalen Vergleich hohe Standards bei der Prävention und der strafrechtlichen Verfolgung. Beim Opferschutz gibt es allerdings deutliche Defizite, die im vergangenen Jahr noch größer geworden sind.
