Abstract

Produktbündel sind im Wirtschaftsleben allgegenwärtig. Sie können zum einen erhebliche Vorteile für Anbieter und Kunden aufweisen, zum anderen können sie aber auch als Instrument zur Behinderung des Wettbewerbs eingesetzt werden. Die ökonomische und rechtliche Würdigung ist daher sehr schwierig und kann zu wettbewerbspolitischen Fehlentscheidungen führen. Dies ist insbesondere bei innovativen Märkten relevant, da die ökonomische Theorie hier nur vereinzelt Erkenntnisse bereitstellt. Eine generelle Untersagung von Bündelstrategien ist insbesondere auf Softwaremärkten als problematisch zu erachten, da neben der Untersagung auch andere Instrumente wie etwa die Verpflichtung zur Offenlegung von Schnittstellen eingesetzt werden können.
