Verantwortliche Vergabe von Ratenkrediten durch Banken: Konzeption, Praxis und Potenziale

Abstract

Appropriate counselling interviews, fair credit conditions and the bank’s support in the case of delinquency constitute essential components of responsible lending. The legislator focuses on information and credit screening obligations. However, a creative leeway has been left for instalment loans. We sketch the results of a credit test encompassing a broad range of banks all over Germany which reveals insufficient credit screening, usurious interest rates and obligatory payment protection insurances among the tested banks thus delivering some proof of irresponsible lending. As a way out we discuss a return to relationship banking addressing the role of artificial intelligence. Wesentliche Komponenten einer verantwortlichen Kreditvergabe sind ein angemessenes Beratungsgespräch, faire Konditionen und eine Unterstützung durch die Bank in Phasen des Zahlungsverzugs. Der Gesetzgeber legt den Fokus auf Informationspflichten und die Pflicht zu einer angemessenen Kreditwürdigkeitsprüfung als Teil des Beratungsgesprächs. Bei Ratenkrediten lässt er den Banken jedoch einen Gestaltungsspielraum. Wir skizzieren die Ergebnisse eines deutschlandweit durchgeführten Kredittests, die unter den getesteten Banken eine unzureichende Erfassung der Bonität der Verbraucherin bzw. des Verbrauchers, Wucherzinsen und Restschuldversicherungen als Voraussetzung für die Kreditvergabe vorfinden und somit Belege für eine unverantwortliche Kreditvergabe liefern. Als Ausweg wird eine Rückkehr zum relationalen Banking unter Nutzung der künstlichen Intelligenz diskutiert.
