Schnittstellenprobleme in Familienpolitik und Familienrecht

Abstract

Measures of family policy are located in different branches of the law, mainly in tax law, social law and civil law governing alimony. In Germany, the bundle of relevant rules has evolved historically. There are thus numerous linkages between its single elements which are shaped deliberately only as a rare exception, but are important for how the existing instruments and legal provisions jointly affect families of differing types. The article provides a survey about such linkages, discusses a number of problems that arise, and illustrates some of the consequences, especially for the financial situation of families. Fundamental questions which are raised relate to the assessment of minimum needs of a child, the multiple functions of the German child benefit (Kindergeld), and the principles for adding and dividing family income after a separation or a divorce. Maßnahmen der Familienpolitik verteilen sich über unterschiedliche Rechtsgebiete, insbesondere das Steuer-, Sozial- und Unterhaltsrecht. Das historisch gewachsene Gefüge dieser Maßnahmen weist zahlreiche Schnittstellen zwischen Einzelregelungen auf, die nur selten bewusst gestaltet sind, für das Zusammenwirken in Familien verschiedenen Typs aber von großer Bedeutung sein können. Der Beitrag gibt einen Überblick über solche Schnittstellen, diskutiert die dabei auftretenden Schnittstellenprobleme und verdeutlicht vor allem ihre Auswirkungen auf die finanzielle Situation von Familien. Als wichtige Grundsatzfragen erweisen sich dabei die Bemessung des Mindestbedarfs von Kindern, die Mehrfachfunktion des Kindergelds sowie die Prinzipien der Zusammenrechnung und Teilung von Einkommen in einer Familie nach einer Trennung oder Scheidung.
