Zur Ökonomik rechtlicher Probleme von Fusionen und Kooperationen auf dem deutschen Pressemarkt

Abstract

Merger control in the field of newspapers should not be loosened. Alternative instruments to protect plurality of media are economically not feasible. On the contrary, it might be justified to make use of merger control to better protect plurality of media. Competition law may well be used to protect certain public goods. Co-operation between newspapers should not be exempted from German cartel law. This would not be feasible in the light of erosion of German cartel law by European competition law. Eine verschärfte Fusionskontrolle im Bereich von Pressefusionen lässt sich mit dem Schutz der publizistischen Vielfalt rechtfertigen. Instrumenten der "inneren Pressefreiheit" ist aus ökonomischer Sicht mit großer Skepsis zu begegnen. Im Bereich der kartellrechtlichen Kontrolle von Kooperationen empfiehlt sich für das Pressewesen kein Sonderweg. Der wäre angesichts der weitgehenden Verdrängung des deutschen Kartellrechts durch das europäische Wettbewerbsrecht auch nicht zweckmäßig.
