Europäische Kapitalmarktunion und die Finanzierung von kleinen und mittleren Unternehmen - Ausgewählte Rechtsaspekte

Abstract

Der Aktionsplan zur Schaffung einer Kapitalmarktunion der Europäischen Kommission ist ein ehrgeiziges europapolitisches Projekt. Es bedarf kontinuierlicher kritischer rechts- und wirtschaftswissenschaftlicher Begleitung und Bewertung. Ein rechtspolitisches Ziel ist es, Finanzierungsoptionen insbesondere für kleine und mittlere Unternehmen (KMU) in der Europäischen Union (EU) zu verbessern. Die Wahl der Mittel und ihr mögliches Potenzial, dieses rechtspolitische Ziel nicht nur marginal zu erreichen, sollten wesentliche Beurteilungskriterien für die Angemessenheit des mit dem Aktionsplan angestoßenen Maßnahmenpakets sein. Dieser Beitrag stellt kritisch aus rechtlicher Perspektive ausgewählte Elemente des Aktionsplans zur Schaffung einer Kapitalmarktunion vor, die Bezüge zur Finanzierung von KMU in der EU aufweisen. / The Action Plan on Building a Capital Markets Union of the European Commission (Action Plan CMU) is an ambitious political project of the European Union (EU). It requires continuous critical scholarly legal and economic monitoring and evaluation. One express objective of the Action Plan CMU is providing more funding choices in particular for small and medium-sized enterprises (SMEs) in the EU. The choice of measures and their possible potential to achieve this goal more than marginally should be important criteria for assessing the adequacy of the package of measures initiated in context with the Action Plan CMU. The paper introduces critically from the legal perspective those components of the Action Plan CMU which might impact financing of SMEs in the EU.
