Abstract

Since the end of 2009, the Supreme Court has promoted the idea of a "decline in the administrative inquest procedure" as a means to limit the sanctioning authority of the Administration. Briefly explained, if a decision on a sanction takes too long to be adopted, it is of no legal value. The idea spread quickly in the legal environment, giving rise to abundant jurisprudence. However, this article questions the legal basis for this doctrine and postulates that the remedies afforded by law to confront tardy administrative action cannot be conceived without regard to the general interest justifying the sanctioning authority of the Administration.
