Justicia transicional en contextos no transicionales: el caso colombiano

Abstract

Entre los anos 2002 y 2006 se dio en Colombia un proceso de negociación entre el Gobierno nacional y varios grupos paramilitares, cuyo fin era la total desmovilización de las Autodefensas Unidas de Colombia (AUC) –uno de los actores del conflicto en Colombia–; este periodo fue denominado como el Proceso de Justica y Paz, el cual fue enmarcado en el enfoque de la Justicia Transicional. Sin embargo, tras un estudio detallado de lo que implica la existencia de este enfoque en un país, se evidencia que la aplicación de este término en Colombia no va más allá de una utilización en el discurso, ya que no existe un contexto de transición de conflicto a paz en el Estado.
