Abstract

El presente trabajo tiene como propósito, analizar los criterios del operador jurídico para la valoración de la responsabilidad empleador por los danos causados al empleado en Colombia. En la realización de este estudio, se empleó un análisis jurisprudencial y doctrinal sobre la responsabilidad subjetiva y objetiva del empleador ante lesiones laborales que traen consigo, la pérdida de la capacidad laboral o incluso, la muerte del trabajador. El estudio se enmarcó dentro del paradigma cualitativo con una fase de tipo descriptiva-documental; a su vez, presenta un diseno bibliográfico para el cual se utilizó como técnica de la recolección de información, la observación documental.
