Normatividad nacional e internacional protectora del derecho a la educación de personas con discapacidad físico-motriz

Abstract

Las personas en condición de discapacidad físico-motriz están protegidas por diferentes instrumentos jurídicos, tanto nacionales como internacionales. En el mandato de la Carta Política de 1991 (art 13) se consagra la especial protección que el Estado debe brindar de manera integral a las personas que se encuentran en situación de debilidad manifiesta por su condición física. Se halla el fundamento de mayor peso para ello en los instrumentos jurídicos nacionales, complementados a su vez, por los internacionales que podrían hacer parte de la legislación nacional por medio del llamado “bloque de constitucionalidad”, lo cual incluye tratados internacionales en materia de derechos humanos, teniendo en cuenta que la igualdad es uno de ellos (derecho humano fundamental). Por ello se hace necesario verificar si realmente se está cumpliendo con esa protección en relación con el acceso a la educación básica, media y superior de las personas con discapacidad físico-motriz.
