¿El derecho postergado? Aproximación al proceso de reparación colectiva en el pueblo Ette Ennaka

Abstract

En la implementación local del concepto de reparación colectiva con enfoque diferencial, es factible evidenciar las divergencias entre la norma y los colectivos sujetos de reparación. El objetivo de este artículo de reflexión, es caracterizar el proceso de reparación colectiva vivenciada por el pueblo indígena Ette Ennaka en el marco de la Ley 1148 de 2011 en Colombia. Metodológicamente, se acudió a la etnografía y a la hermenéutica jurídica, así como al uso de herramientas cualitativas como la entrevista estructurada y la observación participante.
