La negociabilidad de los derechos laborales: un análisis económico

Abstract

Este trabajo presenta los resultados de la investigación aplicada: La negociabilidad de los derechos laborales: un análisis económico", la cual tuvo como objetivo principal analizar la regulación jurídica relativa a la negociación individual de los derechos laborales en Colombia a la luz de los postulados de la economía (Análisis Económico del Derecho - AED), con el fin de identificar la ineficiencia generada por la prohibición de la negociación de los mismos. Tras familiarizar al lector con la disciplina del AED, este artículo analiza las principales normas jurídicas que regulan (y prohíben) la libertad de negociación individual en materia laboral lo cual sumado a las características económicas de los agentes (trabajadores) desata un alto nivel de ineficiencia en el mercado de trabajo."
