Inversión extranjera en el sector financiero : Aprobación por cansancio

Abstract

Desde 1985, cada ano se ha elaborado en Colombia un proyecto de ley nuevo destinado a fijar nuevas normas para la inversión extranjera en el sector financiero. Este es uno de los temas que suscitan emociones realmente fuertes entre los legisladores, y también uno en el que no se ha logrado hacer claridad sobre cuál es el problema, cuáles serían las soluciones y hasta dónde éstas dependen de lo que puede hacer la ley. Las dificultades para lograr un acuerdo sobre el tema han impedido que estas iniciativas culminen con éxito su tránsito en el Congreso. Cinco anos después de la primera propuesta, un proyecto sobre inversión extranjera parece estar, al fin, a punto de convertirse en ley. En 1988 el texto de este proyecto, con ponencia de Hernando Agudelo Villa, fue aprobado por la Cámara de Representantes. En el actual período legislativo el proyecto deberá ser debatido por el Senado y, de aprobarse, pasaría a sanción presidencial. Al parecer, aunque la ponencia de Agudelo Villa introdujo algunos cambios importantes en el proyecto inicialmente presentado por el gobierno, este último desea que el debate no se prolongue indefinidamente, y por ello está impulsando su aprobación por el Senado. Suponiendo que en los tiempos que corren, el apoyo del gobierno a un proyecto de ley ayuda a su tránsito en el Congreso, a partir de 1990 el país contaría con una nueva legislación sobre inversión extranjera en el sector financiero. Resulta oportuno entonces revisar el proyecto y sus orígenes, pues a lo largo de estos anos se registraron cambios tanto en la sustancia del proyecto, como en la situación del sector financiero.
