Análisis económico de la corrupción: una problemática sistemática y generalizada

Abstract

Las reflexiones que se plantean en este docu-mentoobedecen a una serie de cuestionamientos en torno aesta problemática en la búsqueda de una aproximacióndesde la perspectiva del análisis económico de lasnormas. En este sentido, es trascendente tratarde explorar cuáles fueron las condiciones queposibilitaron el estudio académico de la corrupción,en qué radica la preocupación internacional paraabordar este tema de manera amplia y profunda, cuáles el ambiente económico que propicia la corrupción,sus factores deter-minantes, sus costos y efectoseconómicos y sociales, sus relaciones con el sistemalegal, y cuáles han de ser las políticas públicas y laestructura legal adecuadas.Para tratar de hacer más sistemático este análisisse ha dividido en tres partes: la primera, hacereferencia a la fenomenología de la corrupción,la segunda, al sistema normativo frente a la corrupción,y la tercera, a las políticas públicas y lasestructuras legales (instituciones)1 adecuadas parahacerle frente.
