Demanda y oferta judicial: dificultades de ajuste

Abstract

Primera parte: elementos conceptuales. Los esfuerzos de casi dos décadas de reforma judicial en los países de América Latina han generado mejoras palpables en la efectividad de la prestación de los servicios de la administración de justicia. No han sido en vano las reformas constitucionales que replantearon la institucionalidad de la justicia e incrementaron la asignación de recursos hacia las ramas judiciales de las democracias de la región. Sin embargo, a juzgar por las encuestas de opinión y por indicadores sobre productividad de los sistemas judiciales, la aspiración de una justicia pronta, cumplida y accesible está aún lejos de cumplirse.
