Reformvorschläge zum kommunalen Finanzausgleich des Landes Nordrhein-Westfalen

Abstract

Der folgende Beitrag soll anhand der Ergebnisse des Gutachtens einen Einblick in die Systematik und Problematik des Kernstücks des kommunalen Finazausgleichs, das Schlüsselzuweisungssystem, vermitteln. Zunächst wird der Verfassungsauftrag und seine Umssetzung diskutiert. Anschließend wird das Verteilungssystem für die Schlüsselzuweisungen erörtert. Diese erfolgt in einem relativ aufwendigen, iterativen Berechnungsverfahren. Bei der Ermittlung des Finanzbedarfs sollen Bedarfsrelationen zwischen den Gemeinden, geprägt von der landespolitischen Einschätzung der gegenwärtigen Situation sowie den Vorstellungen über eine wünschenswerte zukünftige Entwicklung der Kommunalhaushalte, festgelegt werden. Eine Reform des kommunalen Finazausgleichs ist zweifellos mit erheblichem Durchsetzungs- und Durchführungsaufwand verbunden. Einmal akzeptierte Verteilungsmaßstäbe können aber dennoch nicht unbedingt langfristig Bestand haben. Der Gesetzgeber muß vielmehr flexibel und zeitnah auf bedeutsame Veränderungen der Rahmenbedingungen kommunalen Handelns reagieren.
