Postreform im Lichte der EU-Liberalisierungspolitik

Abstract

Die im Jahr 1989 durchgeführte Postreform I führte die Deutsche Bundespost zu mehr Selbständigkeit und Flexibilität. Eine zweite Reformphase, die noch in der jetzigen Legislaturperiode vollendet werden soll, werden Änderungen im Bereich des Briefdienstes beschlossen. Hierbei sind in einem Grünbuch über die Entwicklung des Binnenmarktes für Postdienste konkrete Mustervorschläge aufgführt, die die EG-Kommision zur Ausweitung des Wettbewerbs unterbreitete. Mit der Öffnung der Postmärkte geht die Einschränkung des Postmonopols einher.Das Grünbuch-Konzept der EG verlangt, daß unabhängige Regulierinstanzen die Ausgewogenheit zwischen öffentlichen und privaten Anbietern gewährleisten. Dies bedeutet, daß jede Maßnahme, die einen unmittelbaren Bezug zur Post hat unterlassen und zurückgenommen wird, wenn sie offenkundig über den Kernbereich des Monopols hinaus zu Wettbewerbsbehinderung oder -verfälschung führt. Da die Deutsche Bundespost Postdienst über ein flächendeckendes Vertriebsnetz verfügt, sollte das Grünbuch-Konzept angenommen werden, um dem Wettbewerb erfolgreich zu bestehen.
