Abstract

The public servant’s duty relationship results from the administrative appointment deed. The public servant is a bearer of public function, that he exercises to the extent of his function; he is an agent of public power: an institution of public law; it is bounded by the regulations especially provided by the Constitution, by the Law no. 188/1999, as further republished, by other administrative law regulations and only in completion by labour law regulations, only to the extent in which they do not disagree with the legislation specific to public function.
