After 50 Years of the Workers’ Statute: A Roadmap for the Future

Abstract

Dopo aver evidenziato che dalle riforme apportate dal Jobs Act è rimasta esclusa la materia dei rapporti collettivi, il contributo si interroga sugli interventi necessari in tale ambito, suggerendo la definizione, per via legislativa, delle regole e dei criteri di rappresentatività delle parti sociali con l’attribuzione a un’autorità amministrativa del compito di certificarne l’effettiva misurazione. Viene, inoltre, ipotizzata l’adozione di strumenti legali di fissazione dei salari, demandando tale ruolo alla contrattazione collettiva, ma prevedendo, al contempo, un salario legale, che funga da minimo invalicabile e da parametro per i settori scoperti. Il contributo mette, inoltre, in luce la necessità di un’universalizzazione – anche oltre il lavoro subordinato e graduando le stesse in relazione alle esigenze di protezione – delle tutele previste dal diritto del lavoro, nonché l’importanza delle politiche concertative per governare la transizione e affrontare l’incertezza legata alla crisi in atto.
