Algorithmes et décision concurrentielle : risques et opportunités

Abstract

The modernization of the implementation of competition rules, initiated by the European Commission in 2005, is based on a more economic approach. This aims at grounding decisions on an assessment of the net effects of practices on consumer welfare. The development of the digital economy, which is characterized by algorithmic, data-driven decisions, raises new challenges for competition authorities. This article presents the difficulties involved in delineating relevant markets, qualifying market practices, and balancing effects. It examines the possibility of regulating algorithms by using algorithms themselves, in both competition law procedures and ex-ante regulation. JEL classification: D43, K21, L41.
