Teoreticko-metodologická východiska vnějších smluv Evropských spoločenství

Abstract

Příspěvek se zabývá vymezením a typologií vnějších smluv Evropských společenství. Oproti standardnímu pojetí vnějších smluv mezi jednotlivými státy je situace v případě vztahu komunitárního, resp. unijního práva a mezinárodního práva veřejného poněkud odlišná. Právní systém ES/EU je svou povahou kombinací různých forem vnitrostátního práva a práva mezinárodního a tvoří tak právní řád sui generis. V článku jsou diskutovány takové okruhy jako jsou např. mezinárodně právní subjektivita ES/EU, typologie vnějších smluv či procedury uzavírání těchto smluv.
