Právna Úprava Obstarávateľských Zmlúv V Ruskom Práve A Jej Porovnanie So Slovenskou Právnou Úpravou

Abstract

Obstarávateľské zmluvy sú významným právnym nástrojom používaným v medzinárodnom obchode využívaným pri distribúcii tovarov alebo služieb. Spája sa v nich právny aspekt, ktorého podstata tkvie v rôznych variáciách právneho inštitútu zastúpenia s ekonomickým aspektom sprostredkovania, t. j. vytvorenia vzťahu medzi poskytovateľom a odberateľom. Právna úprava obstarávateľských zmlúv je v rôznych právnych poriadkoch rôzna. V tomto príspevku sme sa zamerali na právnu úpravu platnú v Ruskej federácii. Zaujímavá je tým, že hoci Rusko je súčasťou kontinentálneho právneho systému, niektoré prvky pri úprave týchto zmluvných typov prevzalo z angloamerického systému práva a zároveň ako nečlenský štát EÚ nie je viazané právnou reguláciou poskytujúcu zvýšenú ochranu obchodnému zástupcovi ako jednému z obstarávateľov.
