Übersicht über die Rechtsprechung zum GenG des Jahres 2008

Abstract

Die Rechtsprechungsübersicht des Jahres 2008 berücksichtigt wie gewohnt in erster Linie Urteile der Zivilgerichte zum Genossenschaftsgesetz (GenG). Entscheidungen des Bundesfinanzhofs (BFH) zu Besonderheiten bei Genossenschaften sind seit der Ab­schaffung der Eigenheimzulage selten geworden. Die Fragestellungen im Jahre 2008 betreffen ähnliche juristische Probleme wie in den letzten Jahren. Es geht um Fragen der Haftung des Vorstands, Vertretungsfragen der Genossenschaft durch den Aufsichtsrat sowie um die Rechte der Mitglieder. Auffällig ist, dass im Jahr 2008 Streitigkeiten, die die Mitgliedschaft in der Genossenschaft betreffen, die Gerichte mit Abstand am meisten beschäftigen.
