Übersicht über die Rechtsprechung zum GenG des Jahres 2006

Abstract

Die Rechtsprechungsübersicht des Jahres 2006 berücksichtigt in erster Linie Urteile der Zivilgerichte zum Genossenschaftsgesetz (GenG). Aber auch Urteile und Beschlüsse der Finanzgerichte zu Besonderheiten bei Genossenschaften (eG) werden erwähnt. Im Jahre 2006 spielten auffällig oft Rechtsfragen zur Mitgliedschaft in der eG, insbesondere zum Austritt oder Ausschluss aus der eG, eine Rolle. Die in der Vergangenheit alles überragenden Fragestellungen zur Haftung der Vorstandsmitglieder traten diesen gegenüber in den Hintergrund. Die Finanzgerichte befassten sich entweder mit genossenschaftsspezifischen Bilanzierungsfragen oder mit der Gewährung von Eigenheimzulage auf Genossenschaftsanteile. Die Rechtsprechungsübersicht enthält außerdem noch eine Entscheidung des Kartellsenats eines Oberlandesgerichts zu Wettbewerbsbeschränkungen durch eine eG.
