Das Schuldanerkenntnis in der Praxis, insbesondere als Mittel der Kreditsicherung

Abstract

Das Schuldanerkenntnis tritt im Wirtschaftsleben in vielfältigen Erscheinungsformen auf. Zu unterscheiden sind und in Wechselwirkung zueinander stehen das deklaratorische, kausale, konstitutive und abstrakte Schuldanerkenntnis. Wichtige Erscheiungsformen der letzten Gruppe sind Saldoanerkenntnisse, insbesondere die Gutschrift im Giroverhältnis, das Kreditkartengeschäft und das POS-System. Das abstrakte Schuldanerkenntnis wird allerdings – gerade bei der Bestellung eines Grundpfandrechts – auch als Kreditsicherungsmittel verwendet
