Eignung der Ausgleichsforderungen aus der Währungsumstellung 1990 als ordentliche Deckung für Schuldverschreibungen

Abstract

Ausgleichsforderungen sind ein Instrument der Währungsumstellung, das in Deutschland 1948 erstmals eingesetzt und 1990 erneut verwendet wurde. Die Zuteilung der Ausgleichsforderungen 1990 hat bis heute eine Vielzahl von Problemen aufgeworfen, deren Lösung einen Vergleich zur Währungsreform 1948 nahelegt. Vor diesem Hintergrund beschäftigt sich der folgende Beitrag mit der Frage, ob die Ausgleichsforderungen 1990 in analoger Anwendung der Regelungen zur Währungsreform 1948 als ordentliche Deckung für Schuldverschreibungen zu qualifizieren sind. Diese Frage stellt sich für Emmissionsinstitute spätestens mit Beginn des Jahres 1995, da die bis zu diesem Zeitpunkt lediglich vorläufig zugeteilten Ausgleichsforderungen nunmehr endgültig festgestellt werde
