Das Stornorecht der Kreditinstitute nach den neugefaßten Allgemeinen Geschäftsbedingungen

Abstract

Durch die Neufassungen der AGB der Kreditinstitute zum 1.Januar 1993 wurden auch die jeweiligen Stornoklauseln geändert. In dem folgenden Beitrag werden die neugefaßten Klauseln zunächst dargestellt und mit den bisherigen verglichen. Danach wird das Verhältnis des Stornorechts zum Bereicherungsrecht hinterfragt. Die Auffassung des Stornorechts als ein vom Bereicherungsrecht unabhängiges Rückbuchungsrecht ist nach der Auffassung des Autors überholt. Daher sind auch die bisher vertretenen Auffassungen zur Rechtsnatur des Stornorechts nicht mehr haltbar. Als neue Erklärungsmöglichkeit wird die Annahme einer Aufrechnung bei der Stornierung skizziert
