Abstract

Mit der hier besprochenen Entscheidung weicht der XI. Senat des ΒGH deutlich von der Tendenz des IX. Senats ab und beurteilt die Mithaftungsverpflichtung einer vermögenslosen Ehefrau für einen vom Ehemann benötigten - über ein gemeinschaftliches Oder-Konto zur Veifügung gesteüten - Betriebsmittelkredit als sittenwidrig. In concreto stellen die Ausführungen des BGH zu § 138 BGB jedoch bloß eine (an sich gar nicht notwendige) sekundäre Eventualbegründung dar. Im vorliegenden Beitrag wird daher auch auf die anderen Aussagen des Urteils Bedacht genommen; dabei werden überdies die Rechtsentwicklungen der letzten fahre sowie weitere einschlägige Entscheidungen berücksichtigt.
