Reform des Fit-and-Proper-Regimes nach den Kommissionsentwürfen (CRD VI)

Abstract

Die Regulierung und Beaufsichtigung der unternehmensinternen Governance von Banken hat in den letzten Jahren eine bemerkenswerte Entwicklung durchlaufen. Einen wichtigen Baustein bilden die aufsichtsrechtlichen Anforderungen an die Eignung von Mitgliedern von Leitungsorganen auf persönlicher und kollektiver Ebene (Fit-and-Proper-Anforderungen). Die von der Europäischen Kommission vorgelegten Vorschläge für ein neues Bankenpaket vom Oktober 2021 (CRD VI/CRR III) sehen eine breitflächige Harmonisierung des Fit-and-Proper-Regimes für Kreditinstitute vor. Sollten die Gesetzgebungsvorschläge umgesetzt werden, hätte dies profunde Auswirkungen auf die Besetzung von Leitungsorganen sowie Inhabern von Schlüsselfunktionen von Kreditinstituten (key function holders).
