Abstract

Art. 6 MAR befreit bestimmte staatliche und private Akteure von den Bindungen des Marktmissbrauchsrechts, wenn sie zum Zweck der Geld- und Währungspolitik, der Staatsschuldenverwaltung oder zur Mobilisierung finanzieller Mittel für notleidende Staaten handeln. Die Vorschrift ist die vermutlich am wenigsten beachtete Norm der MAR. Dies überrascht umso mehr, je näher man sich mit ihr befasst. Die Bereichsausnahme war in schlankerer Form bereits in der Insider-RL enthalten und wurde in der MAR nicht unerheblich erweitert. Sie erlangt mit jedem neuen Anleihenankaufprogramm, Rettungs- oder Hilfspaket der EZB bzw. der EU weitere praktische Bedeutung. Hinzukommt, dass die Vorschrift seit jeher rechtspolitisch umstritten war, und es mit den Juncker- und Cœuré-Fällen aus den Jahren 2011 und 2015 zwei einprägsame Beispiele gibt, um die Grenzen der Bereichsausnahme zu testen. Anlass genug, um Hintergrund, Struktur und Inhalt von Art. 6 MAR auszumessen und ihn auf seine rechtspolitische Überzeugungskraft zu überprüfen.
