Konzeptionelle Grundlagen des Anlegerschutzes

Abstract

Obwohl „Anlegerschutz "Rechtsprechung und Gesetzgebung als Rechtfertigungsgrund der Normproduktion dient, sind dessen konzeptionelle Grundlagen umstritten. Fortschritte sind hier in dem Maße zu erwarten, als sich Juristen und Ökonomen über die anstehenden Regelungsaufgaben und-möglichkeiten verständigen. Der Beitrag versucht, vor dem Hintergrund einer knappen Skizze der Entwicklungslinien des rechtlichen Schutzes von Investoren die Randbedingungen für die Zusammenarbeit von Rechts- und Wirtschaftswissenschaften auf diesem Gebiet darzulegen und die Grundzüge eines Konzepts zur Fortentwicklung des Anlegerschutzes zu unterbreite.
