Abstract

Durch seine Entscheidung vom 16. April 2002 zum Kreditkartengeschäft hat der Bundesgerichtshof eine mehr als zehn Jahre alte gefestigte Rechtsprechung aufgegeben und den Zahlungsanspruch des Vertragsunternehmens gegen das Karteninstitut nunmehr als abstraktes Schuldversprechen qualifiziert. Aus dieser Neuorientierung zieht das Gericht weitreichende Schlüsse für die Verteilung des Risikos des Missbrauchs der Kreditkarte zwischen Kartenunternehmen und Vertragsunternehmen und entscheidet insoweit zu Lasten der Emittenten. Der Autor befasst sich mit der Frage, ob die Kreditkartenunternehmen aufgrund der durch das Judikat geschaffenen neuen Haftungsrisiken das Telefon- und Mailorderverfahren überhaupt in der bisherigen Form aufrechterhalten können
