Abstract

Jens-Uwe Franck und Martin Peitz erläutern die Neuerungen für Sektoruntersuchungen infolge der 11. Novelle des Gesetzes gegen Wettbewerbsbeschränkungen (GWB). Um festgestellten Wettbewerbsstörungen abzuhelfen, ist das Bundeskartellamt nunmehr befugt, Maßnahmen anzuordnen, die von Verhaltensvorgaben bis hin zur Entflechtung eines Unternehmens reichen können. Aus Sicht der Autoren Die Autoren waren am 14. Juni 2023 als Sachverständige zur öffentlichen Anhörung des Wirtschaftsausschusses des Deutschen Bundestags zur 11. GWB-Novelle geladen. Der Beitrag beruht teils auf ihren schriftlichen Stellungnahmen für die Anhörung (Franck 2023a und Peitz 2023); wörtliche Zitate werden insoweit nicht kenntlich gemacht. Darüber hinaus hatte Franck bereits seit Juni 2022 verschiedentlich das Bundesministerium für Wirtschaft und Klimaschutz (BMWK) zur 11. GWB-Novelle beraten. Peitz hatte 2020 zusammen mit Massimo Motta für die Europäische Kommission die ökonomische Expertenstudie zum Vorschlag eines „New Competition Tool“ auf EU-Ebene verfasst (Motta und Peitz 2022). ergänzt dieses neue Regelsetzungsinstrument das Kartellrecht in angemessener Art und Weise.
