Entscheidungspraxis des Bundeskartellamts im Bereich der Bundesliga-Übertragungsrechte

Abstract

In der vorliegenden Arbeit wird die Entscheidung des Bundeskartellamts, ein sogenanntes Alleinerwerbsverbot für Bundesligaübertragungsrechte zu implementieren, kritisch beleuchtet. Wir argumentieren vor dem Hintergrund der wettbewerbsökonomischen Literatur zu vertikalen Beschränkungen, dass die Möglichkeiten potenzielle Wettbewerbsprobleme auf diese Weise zu lösen, sehr begrenzt sind. Stattdessen zeigt unsere Analyse auf, dass die Auflagen des Bundeskartellamts eine wohlfahrtsschädliche Wirkung haben. Die Entscheidung über die Einführung eines Alleinerwerbsverbots hätte in jedem Fall jedoch eine dezidierte Marktabgrenzung und Wettbewerbsanalyse erfordert.
