Deregulierung der Öffnungszeiten und Flexibilisierung der Beschäftigung im Einzelhandel

Abstract

Im Streit um die Ladenöffnungszeiten geht es um die Frage, ob eine gesetzliche Regulierung der Arbeits(zeit)bedingungen einer Branche noch zu rechtfertigen ist. Als Beitrag zur Versachlichung der Debatte werden die Erfahrungen mit der Erweiterung der Öffnungsmöglichkeiten seit 1996 auf der Grundlage repräsentativer Befragungen von Betrieben und Beschäftigten des Einzelhandels bilanziert. Untersucht werden die Effekte auf die Handelsstruktur, die Beschäftigung und die Arbeits(zeit) bedingungen. Es wird gezeigt, dass sich die an die Deregulierung des Ladenschlussgesetzes geknüpften positiven Erwartungen - mehr Umsatz, mehr Beschäftigung - nicht erfüllt haben. Beschäftigung wurde abgebaut und dereguliert, flexible Arbeitszeitregelungen haben zugenommen. Vor dem Hintergrund der branchenspezifischen Bedingungen im Einzelhandel verstärken längere Öffnungszeiten die eingeschlagenen Entwicklungspfade mit negativen Folgen für die Handelsstruktur, die Beschäftigung und die Qualität des Handelsangebotes.
