Pravo Konkurencije U Kontekstu Ozakonjenih Monopolskih Struktura (Competition Law In Context Of Lawyed Monopoly Structure)

Abstract

Cilj ovog rada je da ukaže na kompleksan odnos ekonomske regulacije i prava konkurencije kroz prizmu mehanizma jednog od dva osnovna razloga ulaganja resursa u lobističke aktivnosti od strane kartela: nastojanja da se kartelsko delovanje imunizira od primene prava konkurencije (drugi razlog je pokušaj prevazilaženja problema „slepog putnika” prilikom organizovanja kolektivne akcije kartela). Autor ukazuje na to da karteli kao lobiji imaju podsticaj da izdejstvuju donošenje onih političko–zakonodavnih odluka koje istovremeno zadovolјavaju dva uslova – uspostavlјaju konfrontaciju na relaciji između ekonomske regulacije i dinamike konkurencije na tržištu, ali i između primene ekonomske regulacije i prava konkurencije. Zaklјučak je da takvo traganje za rentom proizvodi negativne posledice na konkurenciju i društveno blagostanje. U cilјu dodatnih pojašnjenja, biće navedeni i pojedini primeri u vezi sa praktičnim delovanjem kartela.
