Pokajnički Program U Pravu Konkurencije – Razlozi Uvođenja, Mehanizmi Delovanja I Problemi U Primeni (Leniency Program In The Competition Law – Rationales For The Introduction, Mechanisms Of Application And Their Limitations)

Abstract

Cilј ovog rada je da ukaže na značaj instituta pokajničkog programa u pravu konkurencije, opiše njegov mehanizam delovanja, kao i da analizira osnovne probleme u primeni koji dovode do njegove ograničene delotvornosti. U radu se najpre razmatraju efekti kartela na društveno blagostanje koji predstavljaju ekonomsko obrazloženje za uvođenje ovog programa a zatim opisuju mehanizmi njegovog funkcionisanja, kao i specifičan problem koji se može očekivati u primeni u domaćoj praksi prava zaštite konkurencije. Reč je o postojanju protivrečnih efekata ovog programa i efekata tužbe za naknadu štete usled povrede konkurencije koja predstavlja važan element privatnopravne zaštite prava konkurencije. U cilju detaljnijeg objašnjenja, analiziraju se rešenja relevantnih domaćih zakonskih propisa.
